These Terms of Service ("Terms") govern your use of the Calypso application ("App"), including all features, content, and services provided through the App ("Service"). By downloading, installing, or using Calypso, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
Calypso is an educational mobile application designed to provide adults with information and guidance on sexual health and wellness topics. The App includes interactive lessons, quizzes, challenges, personalized coaching feedback, and other educational content.
Important: Calypso provides educational information only. The content, lessons, quizzes, and coaching feedback in Calypso are not medical advice, psychological advice, or therapeutic treatment. The App is not intended to diagnose, treat, cure, or prevent any disease, disorder, or medical condition. Calypso does not replace a qualified healthcare professional. If you have specific health concerns, medical conditions, or mental health needs, you must consult with a licensed physician, therapist, or other qualified healthcare provider.
You must be at least 18 years of age (or the legal age of majority in your jurisdiction if higher) to use Calypso. By using the App, you represent and warrant that:
Use of Calypso by anyone under the age of 18 is strictly prohibited. If we discover that you are under 18, we will immediately terminate your account, and you will lose access to all content and purchased subscriptions without refund.
Calypso provides educational information about sexual health and wellness. This information is intended to promote understanding and self-awareness, not to provide medical diagnosis or treatment.

Everyone's body, health situation, and needs are different. Information that applies to some people may not apply to you. Professional guidance is essential for personalized health advice.
You are responsible for maintaining the confidentiality of your account credentials (email, password) and for all activities that occur under your account. You agree to:
You may maintain only one personal account. Creating multiple accounts for a single user or using another person's account is prohibited.
You must provide accurate, current, and complete information during account creation and maintain this information. We reserve the right to disable or delete accounts with false or misleading information.
If you believe someone has accessed your account without permission, contact us immediately. We will work to secure your account and investigate the unauthorized access.
All content within Calypso, including but not limited to lessons, quizzes, illustrations, design elements, text, audio, video, graphics, icons, badges, coaching responses, and any other materials ("Content"), are the exclusive property of Ionut Gheorghe, operating as Calypso, or are used with permission from third-party licensors. The Content is protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to view and use the Content for your personal, non-commercial educational purposes only.
You may not:
If you submit content to Calypso (such as responses to coaching prompts or personal notes), you retain ownership of that content. By submitting it, you grant Calypso a non-exclusive, worldwide, royalty-free license to use, reproduce, and modify that content as necessary to improve and personalize the Service. This allows us to enhance coaching responses and personalization features.
You agree to use Calypso only for lawful purposes and in compliance with these Terms. You specifically agree not to:

All prices are in USD. Prices may vary by region and are subject to applicable taxes and fees.
New users may be eligible for a 7-day free trial of Calypso. After the trial period ends, your subscription will automatically renew unless you cancel before the trial ends.
Important: Your subscription will automatically renew at the end of each billing period unless you cancel. By subscribing, you authorize recurring charges to your payment method.
To cancel your subscription, you must do so through your device's app store settings:
Cancellation through the App itself is not available. You must cancel directly through your app store. Cancellation takes effect at the end of your current billing period.
Refund requests are subject to the refund policies of Apple App Store and Google Play Store. We follow their standard refund guidelines:
Refunds are processed by the app store, not by Calypso directly. Contact the app store if you wish to request a refund. Subscription plans that have auto-renewed cannot be refunded retroactively once the billing cycle has completed, except as mandated by applicable law.
We may change subscription prices at any time. If we increase prices, we will provide you with at least 30 days advance notice via email and/or in-app notification. Continued use of the App after the notice period constitutes your acceptance of the new price. If you do not accept the new price, you may cancel your subscription.
Payments are processed by Apple App Store (for iOS) and Google Play Store (for Android). By subscribing, you authorize these payment processors to charge your payment method. We do not directly collect or store your payment information.
All prices are exclusive of applicable taxes, fees, and charges. You are responsible for paying all applicable taxes, duties, and government fees associated with your purchase.
Calypso is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the App or Service, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that:
We are not responsible for decisions or actions you make based on information in Calypso. You use the App at your own risk and discretion. Any reliance on App content is entirely your responsibility.
To the maximum extent permitted by law, in no event shall Ionut Gheorghe, operating as Calypso, or any of its affiliates, officers, directors, employees, or agents be liable for:
Maximum Liability: Our total liability to you for any claims arising out of or relating to these Terms or the App shall not exceed the amount you paid to Calypso in the 12 months preceding the claim.
These limitations apply regardless of the legal theory (contract, tort, negligence, etc.) and even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Ionut Gheorghe, operating as Calypso, and all affiliated parties from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of the courts located in Delaware.
Before initiating any formal legal proceeding, you and Calypso agree to attempt to resolve any dispute informally. Either party may initiate this process by sending a written notice to the other party describing the dispute in detail. Both parties will then have 30 days to attempt good-faith negotiation and resolution.
If the dispute cannot be resolved informally within 30 days, you and Calypso agree that the dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
You agree that arbitration will be conducted on an individual basis only. You waive your right to participate in class actions, class arbitrations, or representative actions against Calypso. All claims must be brought in your own name, not as a plaintiff in a class action.
Notwithstanding the above, you may bring an action in small claims court in your county if you qualify and the action falls within the court's jurisdiction.
You may delete your Calypso account at any time from the Settings screen within the App. Upon account deletion:

Sections that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Dispute Resolution) shall survive any termination of these Terms.
We may modify these Terms at any time. Changes will be communicated to you via:
Substantial changes to these Terms will include at least 30 days advance notice.
Your continued use of Calypso after receiving notice of changes constitutes your acceptance of the modified Terms. If you do not accept the changes, you should discontinue use of the App and cancel your subscription.
These Terms, together with our Privacy Policy and any other policies referenced here, constitute the entire agreement between you and Calypso regarding your use of the App and supersede all prior understandings and agreements.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
You may not assign or transfer these Terms without our consent. We may assign our rights and obligations under these Terms without restriction.
